PORTER COUNTY BOARD OF COMMISSIONERSREGULAR MEETING
TUESDAY, NOVEMBER 19, 2002
The regular meeting of the Porter County Board of Commissioners convened at 10:00 a.m. on Tuesday, November 19, 2002 in the Commissioners' Chambers of the Administration Center.
Those present: Commissioners David Burrus and John Evans, and Attorney Gwenn Rinkenberger.
President David Burrus called the meeting to order with the Pledge of Allegiance.
APPROVAL OF PAYROLL
Com. Evans moved to approve the payroll of November 18, 2002, Com. Burrus seconded, motion carried.
APPROVAL OF MINUTES
Com. Evans moved to approve the minutes of the Commissioners' regular meeting of November 6, 2002, Com. Burrus seconded, motion carried.
OFFICE HOLDERS/DEPARTMENT HEADS
Tiburon disbursement
David Sheibels, E-911 director
Mr. Sheibels, "This is another routine disbursement from the Bank of America on our Tiburon lease purchase account to pay for Tiburon. Two milestones of the contracted items that they have accomplished for $152,098.00. This is a simple form from the Bank of America to allow them to pay Tiburon that dollar amount for those two milestones at this time."
Com. Burrus, "The mechanism for this I believe, is that you have a purchase agreement through the Bank of America and you are funding them?"
Mr. Sheibels, "Correct. We are paying them three single annual payments and they in turn, as Tiburon completes certain milestones of the project, I approve those milestones and then bring this agreement to you so that Bank of America can cut a check to Tiburon."
Com. Evans, "And where are we with this project? Is this the one where the water ruined the equipment and the software that went with it? Is everything up and running?"
Mr. Sheibels, "Yes. We are in good shape. The entire building is running on the Tiburon system with the exception of the police records and the police civil bureau at this time and we are bringing those systems up to speed as we go along further into the year. We are in good shape and the project is moving along nicely."
Com. Evans, "Are you also a part of the wireless thing going along here? Is that progressing all right?"
Mr. Sheibels, "Yes, the wireless WAN. We just put that in service yesterday and pulled the last few pieces of rotting equipment out of the old building so we are 100% out as of yesterday."
Com. Evans moved to approve the payment to Tiburon, Com. Burrus seconded, motion carried.
Mr. Sheibels, "I do have two minor transfers also for today. The first one is a routine transfer
we find ourselves approximately $6,000.00 short in our telephone line item due to some unexpected Verizon telephone service charge increase that got us the last part of the year. So we are requesting a transfer of $6,000.00 out of maintenance agreements to the telephone line item of the 911 surcharge budget."
Com. Burrus, "Is this related to the Verizon increase you referred to earlier?"
Mr. Sheibels, "Yes this is due to new tariff recalculation that came to Indiana earlier in the year and the tariff is getting re-filed November 25, or next week and will go up again next year. Things just keep going up and up."
Com. Evans moved to approve the transfer, Com. Burrus seconded, motion carried.
Mr. Sheibels, "The second transfer I have is simply an overtime transfer for Jon Miller for
$1,124.00 to pay Jon Miller for 65 hours of overtime incurred during the very hectic and many hours of overtime for the move to the new jail."
Com. Burrus, "Okay, we are familiar with that. This is to bring his overtime and his comp time back to zero."
Com. Evans moved to approve the transfer, Com. Burrus seconded, motion carried.
UPDATE ON NORTH COUNTY COMPLEX AUDIT--SCHOOLEY MITCHELL
Joel Carney
Mr. Carney, "Basically, the audit we did at North County identified 77 lines existing at the county complex. There is one main number that is published and five other lines in a _________ group with the main number to handle incoming traffic to the switchboard. Some of the lines go through the telephone switch, and some of the lines go directly to the switchboard and get dispersed from there or they can call directly to the station if they know what that station number is. At the bottom of the page is the breakdown of each department at North County. It also indicates the number of fax lines in each department. In the case of the assessor's office and the prosecutor's office, they have hunt groups of their own where the call comes in and if that line is busy, it rolls down to the next line. We identified at least six lines that appear to be still in service but not used. Some of them didn't even have telephone instruments tied to the end of them. One of them being in the morgue area where the records are kept and one where the old treasurer's office used to be that are used intermittently when they are doing absentee voting registrations. There are some lines there that appear to be questionable. To sum everything up, as far as savings and the number of lines that are there, we could discontinue and save that monthly charge and tax and so on. There are five other lines that have some questionable use that we might have further discussion on before we up and discontinue them. The monthly savings on the low end would be $141.18 and the high end if we do away with all other lines is $258.83. That is the monthly savings. During this audit it would appear that, kind of having kind of a traffic cop to field calls, there are a lot of people that call who need does have its advantages. We feel that during our investigation we discovered that there are calls that come in that switchboard here that are actually for North County so they flash hook and transfer those calls. Our recommendation is to call forward the six in coming lines to the switchboard here and you still have the function of having someone act as a traffic cop and relieve frustration. It would eliminate the need to duplicate that function at the other location. Call forwarding for those six lines would come in at $21.00 a month. That is our recommendation in the interim."
Com. Burrus, "For anyone who may not be familiar with this topic, at our North County complex we have a situation where one of our full time switchboard operators has retired. The Commissioners looked at that as an opportunity to review the whole process; how we handle the switchboard up there and looking at the number of telephone lines and the entire situation. Joel has conducted an audit and has found out there are some lines not being used that we are paying for. Six of those and five others that are questionable, but more importantly, we are trying to address the question of do we replace the person on the switchboard, do we automate it and make it exclusively where you punch in the numbers to get the office you want or do we try to keep some human element involved. The recommendation is to eliminate the switchboard up there and have all calls come into this building who would then be able to answer it personally and forward the calls to Portage. If that is done, then we would have the opportunity to eliminate one full time position. We could absorb some of the part time people here through attrition. We think that would be the best overall approach on this topic."
Mr. Carney, "I want to mention too, that we looked at some other options. I was looking at various auto attendant and those alternatives ranged from $4,000.00 to $14,000.00 for additional hardware and additional maintenance and support. We felt because of the budgetary situations at present that this would be a good alternative. If things change down the road, we might re-address the situation. So at this time our recommendation is to go the most economical route."
Com. Evans, "I think that is the best solution. Actually, what we are doing is saying the technology we have is okay and this will cost us less."
Com. Evans moved to approve to forward the calls and transfer part time personnel to the Administration Building,
Com. Burrus, "Okay, but what is the procedure going to be to make that happen?"
Mr. Carney, "I will have to revisit those lines to see if they have call forwarding capability. If not, we will have to institute those and then it is just a matter of doing the call forwarding at the North County to this location."
Com. Burrus, "Will that require any additional instruction on the part of our people here?"
Mr. Carney, "I spoke with the switchboard here and they seemed very familiar with the procedure for transferring; they currently do it."
Com. Burrus seconded, motion carried.
Com. Burrus, "One other thing, this audit you conducted at North County proved to be
successful. We are wondering if you could put together a proposal of similar nature and conduct the same type of audit at the court house? What we would like to do is to have you go through our buildings one at a time and see what kind of excesses we might have. If you could do that and report back when you have that done."
COLLEGE SAVINGS WITHHOLDING FUND PROGRAM FOR EMPLOYEES--ALLIANCE MUTUAL FUNDS
Ed Russell
Mr. Russell, "I am going to highlight this and then you can ask me any questions you may have. Thank you for allowing me to present this opportunity for people to put away money through payroll deduction, have it be income tax free and pay for college tax free. On page 7, this explains section 529. Section 529 is a tax law that allows people to invest money, have that grow tax free, and when it comes time to use the money, they use it for college expenses, it is tax free when it comes out. In essence what it means to someone is they reduced the cost of college education by 20 to 40% because of the tax savings they are able to do by saving in this manner. On page 15, we are using the Alliance Mutual Fund plan primarily because we like some of the options they have to offer. They have an aggressive growth portfolio. It has lost 30% over the past year as had many of these. The growth portfolios, about 20% lost the balance per portfolio is zero. It doesn't sound like something you think you want to invest in, but in better times they do much better. It also has the tax and income portfolio that has been about 1% and a bond portfolio that has made about 5%. The portfolio from the service we like the best is called age phased and we think this is the way people should be investing for their college savings, essentially the money manager puts it in more aggressive funds when the child is younger and they make it more conservative the closer they get to college. On page 18, this is a fringe benefit that you offer to the employees and it has no cost to the county. There is no administrative fee to the county and it will help the employees to be able to provide for college for themselves, their children, their grandchildren or cousins if they like. The process is very easy and can be done online. On page 22, the way we implement this, and there are a lot of different ways it can be done. I can sit down with the treasurer and see how he would like to do it. Typically what we do is, put some payroll stuffers in with the checks letting them know it is available, offer an educational program they can attend if they wish, also provide individual consultation to the employees and provide that to any new employees that come on board. We do establish a website, and will say Porter County Government Employees College Savings Program. They can get on there and read about the program. They can print an enrollment form and sign it, send it in, and they are in the program then. Thereafter they can visit the website and take a look at their individual account and see how it is doing. Make changes if they want. Plus it also provides a lot of helpful information on how to evaluate how much you need to be saving for college. They can read about investment options, frequently asked questions, and check their portfolios. Page 35 is a picture of the enrollment form. Once they fill that enrollment form out and they send it in, Alliance sends the county notification this person wants this much money taken out of their check and the county takes care of that. Very little paperwork to the county, very little administration involved. It is a very valuable benefit to the employees. Any questions?"
Com. Evans, "Was this the only plan discussed or is there any other options available?"
Mr. Russell, "This is the only plan that is discussed on that particular website. It is strictly for Porter County employees."
Com. Evans, "And is it strictly for college?"
Mr. Russell, "Yes, strictly for college. And strictly for Alliance. The cost of the programs internal expenses on the funds range from .4% to .16%. If they decide they want to get out of this program before the four years are up, there is a penalty to get out. It starts at 4% and drops about a percent a year over that time period."
Com. Evans, "Who determines the percentages?"
Mr. Russell, "It is listed in the prospectus and it is up to that individual what fund they pick. If they pick a fund is very inexpensive to operate, it is going to cost the .4%. If they pick a fund that is more expensive to operate, it is going to be the 1.6% or anything in between depending on the fund they select."
Com. Evans, "Do they have the ability to change that and is there a maximum number of times of year they can change?"
Mr. Russell, "Not that I am aware of. There is a minimum they can invest and it is a $50.00 a month minimum for the investment. Normally, they charge with these kinds of programs some kind of administrative fee but that fee is waived when they have the payroll deduction program."
Atty. Rinkenberger, "You said there was an early withdrawal penalty. If I start the program now, in four years does all that money become mine or is it going with the deposit?
Mr. Russell, "I believe it goes with the deposit. So when you get ready to take the money out, you will be taking out the money you put in much earlier and probably as they go to college you won't be adding any more, by the time you get to the final one, it should come out even."
Atty. Rinkenberger, "Did you say that there was a bond fund?"
Mr. Russell, "Yes, I noticed they didn't mention it in there, but they do have a bond fund and it is the only one making money right now."
Com. Burrus, "Just as an observation, I think it is an outstanding program and this should be a benefit to the employees and a worthwhile option for our folks who have not had any raises."
Com. Evans, "It doesn't cost us anything and gives them the right to chose? I think it is a good idea, too."
Mr. Russell, "Yes. All that is necessary is that we sign up for the corporate plan so that they can establish this website and it is Porter County Government's website."
Com. Evans moved to approve,
Com. Burrus, "Okay, we can approve this and you can make contact with the Auditor for implementation."

COMMISSIONERS' REPORTS
David Schelling, Highway Engineer
Com. Burrus, "Dave is going to present to us an offer to purchase a piece of land in the town of Pines by INDOT that is adjacent to a state highway improvement project. We own the land and they are requesting to buy this frontage for additional right of way."
Mr. Schelling, "Yes. INDOT is planning a reconstruction project at the intersection of US 12 and State Road 520."
Com. Evans, "That is actually Highway 520; 520 is the shortest US highway in the country."
Mr. Schelling, "It is the connecting road between Highways 20 and 12. It turns out that the County owns a lot at the north side of that intersection. The state would like to buy the piece of property from the County that is about 70 foot long and 20 foot wide. It will give us an extra $2,100.00. I think it is a good idea. I knew they were going to be coming before us and in my mind, I was thinking we could use another $2,000.00 so I am happy about this."
Com. Burrus, "Okay, this is consistent with two other purchases they have made for purchases in the last year for right of way along Highway 6."
Com. Evans, "I thought maybe it would be an ideal spot if we could keep that and make that an entrance to the covered trail for the Calumet Trail."
Mr. Schelling, "I think that would be good except there was a South Shore railroad crossing that they just closed at that location."
Com. Evans moved to accept the state's offer to purchase the land at Highway 12 and 520 for $2,100.00, Com. Burrus seconded, motion carried.
USI CONSULTANTS INVOICE FOR BRIDGE INSPECTION
Mr. Schelling, "I just got the bill from USI Consultants for our bridge inspection and I would
like to get this claim form approved as rapidly as possible so we can get the $17,647.94, its reimbursing the County that amount for the bridge inspection. I just got it this morning and didn't want to sit on it."
Com. Burrus, "So this is a claim going to INDOT that will reimburse us?"
Mr. Schelling, "Yes."
Com. Evans moved to approve, Com. Burrus seconded, motion carried.
North District: John Evans
1. INDOT purchase documents for part of frontage on lots 67 & 69, and all of frontage
on lot 68 of " The Pines Subdivision", this is located on the north side of US 12 at SR 520. The County owns this property and INDOT needs a portion for intersection improvements. Purchase price offer is $2,100.00. Recommend approval.

PLAN COMMISSION
Mr. Nigro, "Good morning. The petitioner in this case, Felix Duron, was requesting a rezone from C-4 and RMH to R-3, multi family. This is presented as Resolution No. 02-11 at the meeting on the 2nd of September. At that time Mr. Duron felt that he would rather preserve the zoning he had on this parcel of land and chose to proceed with a request for a use variance before the Board of Zoning Appeals. He was successful in that."
Com. Burrus, "So he is asking to remove his original request and revert back to the original zoning?"
Mr. Nigro, "Yes, he is."
Atty. Rinkenberger, "Is he withdrawing his request?"
Mr. Nigro, "Yes, it came before the Commissioners in September and at that time he felt he wanted to preserve the zoning so he decided to rescind."
Com. Evans, "But prior to that he filed a request to the BZA? And now he has changed his plan and wants to go back to his original zoning and has withdrawn his application from the BZA?"
Mr. Nigro, "Yes."
Com. Burrus, "But he didn't want to withdraw this one until the BZA approval was in hand."
Mr. Nigro, "And they approved it last month. He no longer needs the rezone."
Com. Evans moved to recommend approval of Resolution No. 02-11, Com. Burrus seconded, motion carried.
REDUCING DAYS FROM 60 TO 30 FOR POLITICAL SIGNS TO BE PUT UP PRIOR TO ELECTION
Com. Evans, "I think we want to send some directive back to the Plan Commission that we
talked about earlier and that is that we should revisit the idea of allowing political signs to be put up for thirty days instead of sixty days prior to the election. We would like you to explore that a little more. That is more in line with the cities. The people of the county won't have to look at them for sixty days."
Mr. Nigro, "Okay."
Atty. Rinkenberger, "We need to modify your previous motion. We don't want to approve the resolution, we want to approve the petition to withdraw."
Com. Evans moved to approve the withdrawal of the request for rezone of Felix Duron, Com. Burrus seconded, motion carried.
Com. Burrus, "In addition to what John said about the duration of the signs, I don't know whose ordinance it is that addresses the location of them, but I would also like to emphasize the fact that they are not to placed in the public right of ways. There has been a number of those violations in the last several years and I think we need to be looking at that."
Com. Evans, "Yes, we will have the Highway Department pick them up because we have had people complain a lot about them."
